1. WHAT IS GDPR

GDPR stands for the Personal Data Protection Regulation. The full name of the act that regulates the processing of personal data is: “Regulation 2016/679 of the European Parliament and of the Council of the EU of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC”.

The main objective of the introduction of the GDPR is to reduce the variation in data protection rules between EU countries and to increase the safeguards for the processing of personal data so that the law keeps pace with changing technology.

2. WHEN WILL THE GDPR APPLY?

27.04.2016r. The European Parliament has adopted by regulation an amendment to the data protection law. All EU countries, including Poland, must adapt their laws to the new regulations, which will be directly applicable from 25.05.2018.

The new rules apply directly, which means that they will not require national implementation (enforcement) independently of the current Data Protection Act of 29 August 1997, which will be completely revised to align it with the GDPR.

3. WHAT IS PERSONAL DATA

This is information about an identified or identifiable natural person (data subject). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of the natural person.

In practice, this can be any data relating to an individual. It is worth remembering that we can find personal data not only in an identity card or passport. Data will also include a telephone number or email address, information that is often not protected with due diligence.

3. In order to issue a bill or VAT invoice for the service, personal data is processed:

  • name / company name,
  • residential / business address,
  • NIP (tax number),


The legal basis for the processing is Article 6(1)(c) of the GDPR, which allows the processing of personal data if the processing is necessary for the fulfilment of a legal obligation incumbent on the controller.

4. Personal data is processed for marketing purposes:

  • name / company name,
  • Telephone no,
  • e-mail address,


The legal basis for the processing is Article 6(1)(a) of the GDPR, which allows the processing of personal data if the data subject has consented to the processing of his/her personal data for one or more specified purposes.

5. In order to provide the newsletter service, personal data is processed:

7. ENTITIES TO WHICH PERSONAL DATA MAY BE COMMUNICATED

The administrator of “Marina Jastrzębia Góra Apartments” transfers the acquired personal data for the purpose of offering the best service to the Client only to authorised employees for the processing of personal data and, like most entrepreneurs, we use the assistance of other entities in our business, which involves the transfer of personal data. Therefore, we may pass on your data to our cooperating booking service, accounting company, lawyers, fast payment service, hosting company, transport company, IT company, insurance company (e.g. necessity of damage repair), security company.
Personal data may also be communicated to public authorities insofar as they are authorised to do so by applicable law and submit an appropriate request.
As a business, we also use popular services and technologies offered by entities based outside the European Union (Microsoft, Google, Facebook). Consequently, the collected data may be transferred to third countries. Therefore, it is the responsibility of each data controller to establish the legal basis for such transfers. For our part, we ensure that, when using our services and technologies, we transfer personal data to entities from the United States and only to those that have joined the Privacy Shield programme, based on the European Commission’s implementing decision of 12 July 2016. Entities that have signed up to the Privacy Shield programme guarantee that they will comply with the high data protection standards that apply in the European Union, and therefore the use of their services and technologies offered in the processing of personal data is lawful.

8. PERIOD OF PROCESSING OF PERSONAL DATA

  1. The personal data obtained in connection with the accommodation contract will be processed for the period of the statute of limitations for tax claims (5 years) or civil law claims of the company or the customer, whichever is later. The length of the period also depends on whether or not both parties are entrepreneurs (3 years or 10 + 1 year).
  2. Personal data obtained on the basis of consent for marketing purposes will be processed for the period of validity of the consent for marketing purposes, but for no longer than 5 years.
  3. Personal data processed mainly for analytical purposes, use of cookies and administration of the website until it becomes obsolete or no longer relevant, but no longer than 3 years.
  4. Personal data obtained in connection with the monitoring will be archived for 30 days from the date of recording, after which it will be permanently deleted.

9. CUSTOMER RIGHTS IN RELATION TO THE PROCESSING OF PERSONAL DATA

Every Customer has the right to access, rectify, erase (right to forget), withdraw or limit the processing of their personal data processed by the Company and trusted partners over time. In addition, each Customer has the right to object to the processing of their data by writing to the contact address: iod@marinajastrzebiagora.pl The Customer also has the right to lodge a complaint in relation to the processing of their personal data with the competent supervisory authority.

10. REQUIREMENT TO PROVIDE PERSONAL DATA

The provision of personal data in the form of name, email address, telephone contact number, age of the child, in the case of a stay in the flats with a child, and vehicle registration number, in the case of parking in the flats, is a requirement for concluding the accommodation contract, but the provision of personal data is also voluntary and at your discretion. Optionally, the client may be asked to provide a document number or pesel number. Failure to provide personal data will prevent the company from concluding the accommodation contract.

11. AUTOMATED DECISIONS BASED ON PERSONAL DATA, INCLUDING PROFILING

The controller does not make fully automated decisions on the basis of personal data, including on the basis of profiling. The content of an enquiry that is sent via the contact form is not assessed by the IT system. The proposed price of the service is in no way the result of an assessment made by the IT system.

12. COOKIES

We would like to inform you that our website uses cookies to collect and process personal data and to analyse website traffic. Cookies are computer data stored in text files and stored on the user’s terminal device (i.e. computer, tablet, smartphone, etc.), which the browser sends to the server each time the user accesses the website from this device while visiting various websites. Users can change their settings regarding cookies independently and at any time, specifying the conditions under which cookies are stored and accessed by the user’s device. 13. NEWSLETTER

The information collected by the Administrator about the Customer is intended for ALTOSUN Sp. Z O.O. Limited Partnership and its service providers so that they can process the Customer’s request to start a subscription. According to the General Data Protection Regulation, the User has the right to access, correct or delete data (right to forget), as well as to object to its processing.   1. In order to use the newsletter service, the user is required to provide his or her e-mail address.
  2. The administrator provides the newsletter service free of charge.
  3. Acceptance of this privacy and cookie policy is voluntary, but necessary to use the newsletter service.
  4. The conclusion of a newsletter contract is possible at any time by filling in the active newsletter form on the website.
  5. For the purposes of providing the newsletter service, the Administrator will process the e-mail address provided by the User in the subscription form.
  6. In order to conclude a newsletter contract, the User is obliged to consent to the processing of personal data by the Administrator for the purpose of sending commercial information and marketing materials, including for direct marketing purposes.
  7. The above consents may be withdrawn at any time, thereby terminating the contract for the provision of the newsletter service.
  8. The user is entitled to terminate the newsletter contract at any time by unsubscribing from the Administrator’s subscriber list. This can be done by clicking on the appropriate tab on the newsletter form that reads “To unsubscribe from email click here”.

14. FORMS

The data controller uses three forms within the website:
