Terms and conditions of stay at Marina Jastrzębia Góra Apartments
§1
General provisions
- The Regulations specify the terms and conditions of use and stay in flats rented from Altosun Spółka z ograniczoną odpowiedzialnością Spółka Komandytowa (hereinafter referred to as “Altosun”), 16 Władysława Reymonta Street, 80-290 Gdańsk.
- By booking a flat, you are deemed to have read and accepted the provisions of these Terms and Conditions.
- Definitions:
Facility – a complex of buildings located in Jastrzębia Góra at 36 Rozewska Street, also referred to as ‘Marina Jastrzębia Góra Apartments’, comprising flats owned or operated by Altosun, as well as other flats not managed by Altosun, and a swimming pool, playroom and other parts of these buildings, as well as the playground, gym, car park and passageways located next to these buildings and managed jointly by the housing community.
Client – the person renting a flat owned or offered by Altosun.
Guest – the Client and persons who stay with the Client in the flat rented by the Client, in accordance with the flat reservation made.
Attractions – discounts on water sports, bicycles – subject to availability, animations on selected dates-confirmed by email.
§2
Apartment rental period
- The booked flat is available to the client at the earliest from 16:00 on the first day of the booked flat rental period until 10:00 on the last day of the booked flat rental period.
- If the client does not show up at the accommodation facility on the day of arrival and has paid for the entire stay on that day, the booking is cancelled and the deposit remains with the operator.
- Earlier arrival, based on current flat availability, is only possible by prior arrangement with the office at 668-666-444.
- Late departure: based on current flat availability, must be agreed with a member of the reception staff and confirmed by email for an additional fee:
• Extension of the rental period until 12:00 on the last day of the booked stay – charge of PLN 100
§3
Check-in and key collection policy
- The check-in procedure requires the client to show a valid photo ID and provide a credit card number and expiry date.
- For the duration of the rental of the flat, a deposit is collected from the client, no later than on the day of the client’s arrival, as security for the entrusted, fully equipped flat.
- The deposit is collected in cash only.
- The deposit is between PLN 300 and PLN 1,000, depending on the size of the flat.
- The deposit, in cash, is refunded at the end of the stay, subject to §8 of these Regulations.
Deposit rates:
- 1 bedroom apartment (2 persons) – 300zł
- 2-room apartment (3 persons) – 500zł
- 2-room apartment (4 persons) – 500 zł
- 3-room apartment (6 persons) – 700 zł
- Altosun reserves the right to refuse to accept a Customer who:
• does not have a valid ID card or does not want to show the document,
• refuses to make a cash deposit, or refuses to provide the card number and expiration date as collateral,
• is under the influence of alcohol or other intoxicants, or other Guests are in such a state,
• grossly violated these Rules and Regulations or other Rules and Regulations in effect at the Facility during his previous stay. - In the event that more Guests arrive at the booked apartment than the number of Guests notified at the time of booking, or in excess of the capacity of the booked apartment, such circumstance will be considered a violation of the Terms and Conditions of Reservation and will result in cancellation of the reservation and forfeiture of previously paid funds by the Client.
- Office opening hours – Marina Jastrzebia Gora Apartments, 36 Rozewska St., 84-104 Jastrzebia Gora: daily at: 09:00 – 11:00, 16:00 – 19:00
- Late arrival, outside office hours, is possible with the approval of an Altosun employee, after prior phone contact at 668-666-444, made before 16:00 on the day of the planned start of the apartment rental, and is associated with an additional fee , according to the price list below:
Arrival:
16:00-20:00 Free
20:00-22:00 Fee 100 PLN
After 20:00- Fee of 200 PLN
Departure:
9:00-10:00 Free
- The client is required to complete check-in formalities and pick up the keys to the apartment before the apartment rental begins. These activities are carried out during office hours, with the mouth and nose covered.
- The keys to the apartment will be issued upon payment for the entire reserved rental period of the apartment, taking into account the previously paid reservation deposit (down payment).
§4
Vehicle parking
- Only one parking space in an open unguarded parking lot is dedicated to each apartment, subject to availability. It is not possible to reserve a parking space.
§5
Securing the facility
- The parking lot is open, not guarded or monitored.
- Security guards, if they are at the Property at the time, do not have custody of and are not responsible for vehicles and other belongings (bicycles, strollers, etc.) of Guests located in the Property, including apartments.
- Altosun is not obliged to close the entrance gate to the Facility, including at night.
- Exterior lighting of the Facility is turned off during the hours regulated by the arrangements of the residential community, usually by 11 p.m.
- Minors are the responsibility of their guardians under whose care they remain throughout their stay at the Facility.
- Recreational parts of the Facility, i.e. swimming pool, playgrounds, are not guarded and minors are allowed on them only under the supervision of adult guardians.
- Altosun is not responsible for property left on the premises of the Property, including in the apartment, therefore Guests should not leave valuables unattended.
§6
Check-out and return of keys
- Handing over the key at the end of the lease of the apartment takes place in the office of Apartments Marina Jastarnia on the day of departure from 9:00 – 10:00.
- Apartments after departure are checked by the staff of the facility, in case of defects, damage or loss of equipment in the apartment, guests will be charged extra for the damage or loss of equipment.
- A Guest who intentionally or accidentally destroys property located in the Facility is obliged to repair the damage on general principles, in accordance with the Civil Code.
- All claims for any damage verified at the time of acceptance of the apartment by the staff, will be pursued through the courts, if it is not possible to enforce them amicably.
- In case of losing the keys, magnetic card (so-called watch) to the Facility, the Client shall pay a fee in the amount of 200 PLN.
§7
Silence at night
- Guests are obliged to observe the rules of good neighborliness, and in particular to observe quiet hours from 10 pm to 6 am.
- In the case of a reported disturbance of the peace, Altosun has the right to impose a fine of PLN 500 on the Guests by adding it to the Client’s bill, regardless of whether the disturbance was committed by the Client or the Guests staying with him.
§8
Responsibility for the apartment
- Altosun reserves the right to collect a deposit in cash only, for which an appropriate receipt is issued and given to the client in the amount of 300-1000 PLN, in accordance with §3 of these Regulations, as security for possible claims for damages during the stay.
- Damage amounts are valued on the basis of current prices of products and services (they can be determined on the basis of prices shown on the Internet at a given moment).
- An approximate price list is available at the reception of the facility.
- The deposit is refunded to the Client on the day of departure in full in cash only after handing over the deposit return receipt, if no damage has been caused in the apartment or in the Facility, otherwise the deposit is refunded after deducting the costs necessary to repair the damage caused.
- The client is responsible for all damages caused by Guests staying in the rented apartment.
§9
Conditions of use of the apartment
- Guests are required to dispose of trash before leaving the apartment, as this activity is not included in the final cleaning of the apartment.
- Each time guests leave the apartment, they are required to close all windows and lock the exit door on all locks to which they have received keys.
- Guests are required to pay special attention to the proper operation of water valves and electrical appliances.
- For reasons of fire protection, Guests are not allowed to use any electricity-powered devices that are not part of the premises’ equipment except: chargers for cell phones, laptops and other mobile devices, razors, hair dryers.
- Personal belongings left in the apartment by Guests ending their stay will be sent back at the Client’s expense by courier, to the address indicated. If not disposed of, Altosun will store the items for a period of 7 days and then discard them or donate them to charity.
- Guests are required to maintain the apartment in the condition it was in when they began their stay.
§10
Smoking ban
- Smoking is strictly prohibited in the apartment.
- Violation of this prohibition is punishable by a fine of PLN 500, added to the Client’s bill¸ regardless of whether the prohibition was violated by the Client or the Guests staying with him.
§11
Price change
Altosun is not obliged to reduce the rental fee of an already booked apartment, even in a situation where the client has booked the apartment for a period of time.
Altosun offers to rent similar apartments at a lower price than the price that was indicated to the client during his reservation.
§12
Pets
- Guests are not allowed to keep pets in the apartments without prior approval from Altosun.
- The facility does not accept animals, however, in a special case after receiving prior written consent for the stay of an animal in the apartment, the client is required to pay an additional fee of 200 PLN for the entire period of renting the apartment.
§14
Emergency Situations / Force Majeure
- In case of unforeseeable circumstances, the effects of which cannot be immediately eliminated by customary means, Altosun, reserves the right to offer the Client a substitute apartment, to reschedule the reservation, to change a facility of a similar standard, or to cancel the reservation (only in case Altosun is unable to reschedule the reservation or provide a facility of a similar standard). This also applies to cases in which the personal safety of Guests or their property, for reasons beyond Altosun’s control, cannot be guaranteed. Amounts paid by the Client are subject to immediate refund, with deduction of amounts due for services already rendered, if other solutions do not come into effect (rescheduling of the reservation, substitute apartment or change of facility of similar standard).
- In the event of cancellation by Altosun, for reasons beyond its control “e.g. Covid 19 at the facility”, Altosun undertakes to refund the reservation deposit (down payment), but is not obliged to pay any penalties, damages, etc.
§15
Accidents
- Altosun undertakes to remove any defects arising in the apartment without undue delay 72 h, unless the nature of the defect requires a longer repair time.
- Breakdowns due to reasons beyond Altosun’s control, (supply of utilities, including TV and Internet, breakdowns of equipment in the apartment), lack of access to the swimming pool, playgrounds or lack of attractions do not constitute grounds for cancellation of the reservation or rental of the apartment and thus is not grounds for reduction or refund of the rental fee or reservation deposit (deposit).
§16
Dispute resolution
- The law applicable to disputes between Altosun and the Client or Guest is Polish law.
- Disputes will be settled by the court having jurisdiction over Altosun’s registered office.
§17
Final provisions
- The number of guests in the apartment must not exceed the number specified in the booking confirmation. If this number is exceeded, the company has the right to charge a fee for each additional person in the amount of 150 PLN or terminate the apartment rental agreement with immediate effect without refunding the reservation deposit paid.
- All additional services/products offered at the facility are at an additional cost.
- Altosun does not provide daily apartment cleaning services, change of linens and towels, and does not furnish apartments with additional equipment other than what is in the apartment at the time it is released to the client.
- Persons who are not Guests, as defined in these Regulations, are not allowed to enter the premises, including the swimming pool, indoor playground, indoor playground, gym, etc.
